1. Agreement to terms

By using Fexyn VPN, you agree to these Terms of Service. If you don't agree, don't use the service.

These terms form a binding agreement between you and Fexyn LLC, a Wyoming corporation (“Fexyn,” “we,” “us”). They apply to the Fexyn VPN desktop client, mobile apps, web dashboard, and all related services (collectively, “the Service”).

We may update these terms. When we make material changes, we will notify you by email at least 30 days before they take effect. Continued use after that notice period means you accept the updated terms. If you disagree, cancel your subscription before the change takes effect.

2. Service description

Fexyn VPN is an encrypted VPN service. We route your internet traffic through our servers using one of three protocols: Fexyn Bolt (WireGuard), Fexyn Stealth (VLESS Reality), or Fexyn Secure (OpenVPN). The Service includes the VPN client software, the web dashboard at fexyn.com, and access to our VPN server network.

Fexyn VPN is not a guarantee of anonymity. It encrypts your connection and masks your IP address from the sites you visit, but it is not a shield for illegal activity. We are not your lawyers and this is not legal advice. If you need legal guidance about VPN use in your country, consult a qualified attorney.

3. Eligibility

You must be at least 16 years old, or the age of majority in your jurisdiction (whichever is higher), to use the Service. You must have the legal capacity to enter into this agreement. You must not be on any US government restricted party list (see Section 12, Export Controls & Sanctions).

4. Account registration and security

One account per person. Provide accurate information when you register. You are responsible for keeping your login credentials secure. If you become aware of unauthorized access to your account, notify us immediately at support@fexyn.com.

We may suspend or terminate accounts that violate these terms, that provide false registration information, or that show signs of unauthorized use.

5. Acceptable use

Use the Service lawfully and responsibly. The following are prohibited:

• Any activity that violates applicable law
• Unauthorized access to computer systems or networks
• Distribution of malware or other harmful software
• Sending unsolicited bulk messages (spam)
• Harassment, stalking, or threats against any person
• Child sexual abuse material, in any form, without exception
• Facilitating terrorism or human trafficking
• Interfering with the Service or degrading it for other users
• Circumventing device or bandwidth limits on your plan
• Reselling, redistributing, or sublicensing the Service

Violating these rules may result in immediate account termination without refund. We cooperate with law enforcement when legally required.

6. Subscriptions and billing

Fexyn VPN is a paid subscription service. Plans are billed on a recurring basis (monthly, quarterly, biannually, or annually) through Stripe. Cryptocurrency payments are processed through 0xProcessing.

Auto-renewal: Your subscription renews automatically at the end of each billing period at the then-current price, unless you cancel before the renewal date. You authorize us to charge your payment method on file for each renewal. We will send a reminder email before each renewal.

Free trial: New accounts receive a 7-day trial with full access. After the trial, a paid subscription is required. You will not be charged until the trial ends.

Price changes: We may change subscription prices with 30 days' email notice. Existing subscribers keep their current rate until their next renewal after the notice period.

Taxes: Prices are displayed in USD. You are responsible for any applicable sales tax, VAT, or other taxes required by your jurisdiction.

Failed payments: If a payment fails, we will retry for up to 7 days. If payment remains unsuccessful, your subscription will be suspended. You can reactivate by updating your payment method.

7. Refund policy

We offer a 30-day money-back guarantee on your first paid subscription. If you are not satisfied within the first 30 days, contact support@fexyn.com for a full refund.

The 30-day guarantee does not apply to subscription renewals. Partial-month refunds are not available after the guarantee period. Cryptocurrency payments are refunded to the original wallet address in the original currency.

8. Cancellation

Cancel your subscription at any time from your billing dashboard. You don't need to email support or call anyone.

When you cancel, your access continues until the end of your current billing period. After that, your VPN access stops. Your account data is deleted according to our Privacy Policy.

9. Privacy and data

We operate a no-logs VPN. We do not store your browsing history, traffic content, DNS queries, or the IP addresses you connect to. We retain minimal account metadata (email, subscription status, device count) required to run the service.

10. Intellectual property

Fexyn owns the Service, including the software, website, brand, and all associated trademarks. We grant you a limited, non-exclusive, revocable license to use the Fexyn VPN client software for personal use (or organizational use under a Teams plan) as long as your subscription is active.

You may not reverse engineer, decompile, disassemble, or create derivative works from our software. If you provide feedback or feature suggestions, we may use them without compensation or attribution.

11. Third-party services

Fexyn uses Stripe to process payments and self-hosted Keycloak for authentication. Your use of these services is subject to their own terms. We are not liable for service disruptions caused by third-party providers.

12. Export controls and sanctions

Fexyn LLC is registered in Wyoming, United States. The Service incorporates encryption technology subject to US Export Administration Regulations (EAR).

By using the Service, you represent and warrant that:

• You are not located in, or a national or resident of, any country subject to US economic sanctions, currently including North Korea, Cuba, Iran, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine.
• You are not listed on, and are not acting on behalf of any person listed on, any US government restricted party list, including the OFAC Specially Designated Nationals (SDN) List, the BIS Entity List, or similar lists maintained by the Department of State.
• You will not use the Service to conduct transactions with or on behalf of any sanctioned person or entity.
• You will not re-export or transfer the Service or any underlying technology to any prohibited destination, entity, or individual.

Fexyn VPN is available to individual users in Russia and China. Providing VPN services to individuals in these countries is permitted under current US regulations. Russia is not subject to comprehensive US sanctions (OFAC guidance), and no comprehensive China sanctions exist. All users, regardless of location, must comply with the sanctions requirements above.

We reserve the right to restrict access from any jurisdiction if required by changes in law or regulation.

13. Disclaimers

The Service is provided “as is” and “as available.” We do not guarantee:

• Uninterrupted or error-free service
• Specific connection speeds or latency
• That the VPN will work in all countries (governments and ISPs may block VPN protocols)
• Protection against all security threats (a VPN encrypts your connection, but it does not make you untraceable or immune to malware)

We may modify, suspend, or discontinue any part of the Service at any time. We will give reasonable notice for planned changes that affect your subscription.

14. Limitation of liability

To the maximum extent permitted by law, Fexyn is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses resulting from your use of (or inability to use) the Service.

Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months before the claim arose.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

15. Indemnification

You agree to indemnify and hold Fexyn harmless from any claims, losses, or expenses (including reasonable legal fees) arising from your use of the Service or your violation of these terms.

16. Governing law and disputes

These terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles.

Before filing any claim, contact us at legal@fexyn.com to attempt resolution. If we cannot resolve the dispute within 30 days, either party may initiate binding arbitration under the American Arbitration Association (AAA) rules, conducted in Sheridan, Wyoming.

All disputes will be resolved on an individual basis. You waive any right to participate in a class action or class arbitration.

If you are a consumer in the European Union, nothing in this section limits your rights under mandatory EU consumer protection laws, including your right to bring proceedings in your country of residence.

17. General provisions

• Severability. If any part of these terms is found unenforceable, the remaining terms continue in effect.
• No waiver. Our failure to enforce a right does not waive that right.
• Entire agreement. These terms, together with our Privacy Policy and any plan-specific terms (Teams, DPA, SLA), constitute the entire agreement between you and Fexyn.
• Assignment. We may assign these terms in connection with a merger or acquisition. You may not assign your account or rights without our consent.
• Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, war, government actions, or internet infrastructure failures.
